By accessing or using EnergyMatch (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the app.
If you do not agree to these Terms, do not use EnergyMatch.
These Terms constitute a legally binding agreement between you and Mackay Advisory ("EnergyMatch", "we", "us", or "our"), a company registered in Australia.
To create an EnergyMatch account, you must be at least 18 years of age. EnergyMatch accounts are intended for parents and guardians, not for the child athletes themselves.
You may add child athlete profiles to your account for children aged 5 to 18. By adding a child profile, you confirm that:
EnergyMatch is designed with the UK Age Appropriate Design Code (Children's Code) in mind. Accounts are held by adults (parents and guardians), not by children. We do not permit children to create their own accounts, provide consent independently, or access the service directly. We collect only the minimum data necessary to provide personalised nutrition guidance, do not use children's data for profiling or advertising, and do not apply dark patterns to encourage data sharing beyond what is necessary for the service.
EnergyMatch accounts are for individual family use. One account may contain multiple child profiles (e.g. siblings). We ask that you do not create multiple accounts for the same family, as this can lead to fragmented data.
You agree to provide accurate information when setting up your account and child profiles. The quality of nutrition guidance provided by EnergyMatch depends directly on the accuracy of the information you enter.
EnergyMatch provides general nutrition guidance only. The meal timing suggestions, nutrition targets, and food recommendations in this app are based on published sports nutrition guidelines for young athletes. They are not medical advice and are not a substitute for personalised advice from a qualified professional.
Consult your healthcare team before using EnergyMatch if your child has any medical condition, including but not limited to:
EnergyMatch is not a dietitian, doctor, or sports medicine professional. If your child experiences any adverse health effects, stop using the app's recommendations and consult your healthcare provider immediately.
The nutritional science underlying EnergyMatch is based on peer-reviewed research in paediatric sports nutrition. A list of references is available within the app by tapping "Evidence-based" on the home screen.

You are responsible for the accuracy of the information you enter into EnergyMatch, including child profiles, meal logs, and training data. We provide guidance based on what you tell us — inaccurate inputs will result in less useful recommendations.
EnergyMatch is for personal, family nutrition planning. You may not:
The EnergyMatch application, its design, software code, nutrition algorithms, and all content created by us are owned by Mackay Advisory and protected by Australian copyright law and applicable international intellectual property laws.
The food composition data used by EnergyMatch is sourced from the FSANZ AUSNUT food composition database, published by Food Standards Australia New Zealand (FSANZ) and available under their terms of use.
Your data is yours. The meal logs, child profiles, and training data you enter into EnergyMatch remain your property. We do not claim ownership over your data. You can request a copy or deletion of your data at any time — see our Privacy Policy.
Our Privacy Policy explains in detail how we collect, use, store, and protect your data. It forms part of these Terms. By accepting these Terms, you acknowledge that you have read our Privacy Policy.
In summary: we collect health data about your child to provide personalised nutrition guidance. We do not sell this data. We use a small number of trusted third-party services (Supabase for data storage, Umami for analytics) as described in the Privacy Policy.
During the beta period, EnergyMatch is provided "as is" with no uptime guarantee. We may take the service down for maintenance, updates, or due to technical issues without prior notice (though we will try to give warning where possible).
We reserve the right to modify, suspend, or discontinue any part of EnergyMatch at any time. We will provide reasonable notice before discontinuing the service permanently.
If we make significant changes that would affect your stored data (such as a data reset during beta), we will notify account holders by email with as much advance notice as practicable.
Nothing in these Terms limits rights you have under the Australian Consumer Law that cannot be excluded by contract, including consumer guarantees.
To the maximum extent permitted by applicable law (including the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth)), EnergyMatch and its officers, employees, and agents:
Important: If you are a consumer within the meaning of Australian Consumer Law, you have rights and remedies that cannot be excluded, restricted, or modified. Our liability for a breach of a consumer guarantee is limited, to the extent permitted by law, to resupplying the service or paying for the cost of resupplying the service.
Nothing in these Terms affects your rights under UK consumer protection law (for UK users) or Canadian consumer protection law (for Canadian users).
These Terms are governed by the laws of the State of New South Wales, Australia. Any dispute arising from these Terms or your use of EnergyMatch will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction require otherwise.
If you have a dispute with us, we encourage you to contact us first at hello@energymatch.app and we will attempt to resolve it informally within 30 days.
Nothing in this clause limits your ability to seek interim relief (e.g. an injunction) in any court, or prevents Australian consumer complaints being handled by the relevant state or territory fair trading body.
We may update these Terms from time to time. When we do, we will:
Your continued use of EnergyMatch after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree, you may delete your account before the effective date.
You may delete your account at any time by emailing hello@energymatch.app with the subject "Delete my account". Account deletion will result in the permanent deletion of your data within 30 days, as described in our Privacy Policy.
We reserve the right to suspend or terminate your account if you violate these Terms, particularly the acceptable use provisions in Section 5. We will provide notice where practicable.
